Terms of Service

1. Acceptance of Terms

By accessing or using FormFast ("the Service"), operated at formfa.st, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

We may update these Terms from time to time. If we make material changes, we will notify you via email or a notice on the Service. Continued use after changes constitutes acceptance.

2. Definitions

• "Service" — the FormFast platform, including the website, API, dashboard, and all related tools
• "Account" — your registered FormFast account
• "User Content" — any data, text, files, or materials you submit to or through the Service
• "Form Submissions" — data submitted by end users through your form endpoints
• "End Users" — individuals who submit data through your forms
• "Subscription Plan" — the tier of service you are subscribed to (Free, Pro, Business, or Enterprise)

3. Eligibility

You must be at least 18 years old (or the age of legal majority in your jurisdiction) to use FormFast. By creating an account, you represent that you have the legal capacity to enter into a binding agreement.

4. Account Registration

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your account credentials
• You must notify us immediately of any unauthorized use of your account
• You are responsible for all activities that occur under your account

5. Service Description

FormFast provides form backend endpoints that accept HTML form submissions and deliver them to you via email notifications, webhooks, and a web dashboard. Additional features include spam protection, file uploads, analytics, auto-reply emails, and team collaboration, depending on your Subscription Plan.

6. Subscription Plans and Billing

• The Free plan is available at no cost with usage limits as described on the pricing page
• Paid plans (Pro, Business, Enterprise) are billed monthly via Stripe
• Subscriptions renew automatically. You may cancel at any time from your dashboard
• Upon cancellation, your paid features remain active until the end of the current billing period
• Refunds are provided at our discretion; contact support within 14 days of a charge for consideration
• We reserve the right to change pricing with 30 days' notice
• You are responsible for any applicable taxes

7. User Content and Data Ownership

You retain ownership of all User Content and Form Submissions. By using the Service, you grant us a limited, non-exclusive license to process, store, and transmit your data solely to provide and improve the Service.

You are the data controller for Form Submissions collected through your endpoints. You are responsible for ensuring that your collection of data from End Users complies with applicable laws, including providing adequate privacy notices and obtaining necessary consents.

8. Acceptable Use Policy

You agree not to use FormFast to:

• Send, facilitate, or collect data for unsolicited bulk email (spam)
• Conduct phishing, social engineering, or fraud
• Distribute malware, viruses, or malicious code through file uploads or form endpoints
• Collect personal data from End Users without their knowledge or consent
• Violate any applicable law, regulation, or third-party right
• Infringe upon intellectual property rights
• Attempt to gain unauthorized access to FormFast systems or other users' accounts
• Overwhelm, disrupt, or interfere with the Service or its infrastructure
• Circumvent rate limits, usage quotas, or security measures
• Use the Service for any activity that violates the AWS Acceptable Use Policy
• Use the Service in connection with illegal activities, including but not limited to money laundering, terrorism financing, or the sale of controlled substances

We reserve the right to suspend or terminate accounts that violate this policy, with or without notice.

9. Intellectual Property

The FormFast service, including its name, logo, design, code, and documentation, is owned by FormFast and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our written permission.

10. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

11. Uptime and Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. Scheduled maintenance, infrastructure issues, or events beyond our control may cause temporary downtime. We are not liable for any losses resulting from service interruptions.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED AND ERROR-FREE OPERATION.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FORMFAST SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, REVENUE, OR PROFITS, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO FORMFAST IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

14. Indemnification

You agree to indemnify and hold harmless FormFast and its officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your User Content or Form Submissions; or (d) your End Users' activities.

15. DMCA and Copyright

If you believe content on FormFast infringes your copyright, please send a DMCA takedown notice to contact@formfa.st with: (a) identification of the copyrighted work; (b) identification of the infringing material; (c) your contact information; (d) a statement of good faith belief; and (e) a statement under penalty of perjury that the information is accurate.

16. Termination

• You may delete your account at any time from the dashboard settings
• We may suspend or terminate your account for violation of these Terms
• Upon termination, your data will be deleted in accordance with our Privacy Policy
• Sections that by their nature should survive termination (including Disclaimers, Limitation of Liability, Indemnification, and Dispute Resolution) will remain in effect

17. Export Compliance

You agree to comply with all applicable export and import laws, including US export regulations. You represent that you are not located in a country subject to US trade sanctions and are not on any US government prohibited party list.

18. Dispute Resolution

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any dispute arising from these Terms or the Service shall first be resolved through good faith negotiation. If unresolved within 30 days, either party may pursue binding arbitration under the rules of the American Arbitration Association.

YOU AGREE TO RESOLVE DISPUTES ON AN INDIVIDUAL BASIS AND WAIVE THE RIGHT TO PARTICIPATE IN A CLASS ACTION. You may opt out of this arbitration clause by sending written notice to contact@formfa.st within 30 days of creating your account.

19. General Provisions

• Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and FormFast
• Severability: If any provision is found unenforceable, the remaining provisions remain in effect
• Waiver: Failure to enforce any right does not waive that right
• Assignment: You may not assign your rights under these Terms without our consent. We may assign our rights at any time
• Force Majeure: Neither party is liable for delays caused by events beyond reasonable control, including natural disasters, war, or infrastructure failures
